These terms and conditions (the "Terms") shall apply to your purchase of any short Course from us.

Please ensure that you read and accept these Terms prior to submitting a booking.

1. Definitions

a)    “Course” means the training Course offered by  JTL and purchased by you;

b)    “Delegate” means the person who will be attending the Course;

c)     “Fee” means the price payable for the Course and/or Materials

d)    “Materials” means the documents which accompany or supplement a Course

e)     “you/your” refers to the Delegate and/or the person or organisation which has purchased the Course on behalf of the Delegate, as the case may be.

f)      “we/us/our” refers to JTL, having its registered office at Stafford House, 120-122 High Street, Orpington, Kent BR6 0JS.

2. The Contract

2.1. By submitting a booking, you agree that you have read, understood and accepted these Terms.  If you are an employer booking on behalf of a delegate you are responsible for the delegate’s compliance with our Terms..

2.2. When you submit a booking to us, this does not mean that we have accepted or will accept your booking.  Our acceptance of your booking will only take place when we issue you with a written acceptance of the booking by confirming a place for you on the relevant Course, at which point a legally binding contract will come into existence between you and us.  If, for any reason, we are unable to accept your booking, we will inform you of this and we will not process the booking or accept payment.

3. Booking

3.1. All Course bookings are subject to availability.  Course availability can only be confirmed when you have been sent a Course confirmation email containing your joining instructions and once payment has been authorised and collected. 

3.2. All Fees will be clearly outlined during the booking process.  VAT is not payable on our short Courses.

4. Cancellation by JTL

4.1. We reserve the right to cancel, reschedule or change the location of your Course at any time, or to cancel an advertised Course due to insufficient bookings, or through circumstances beyond our reasonable control. In these circumstances, the liability of JTL shall be limited to the return of all monies paid, or to a transfer onto another JTL Course or location.

5. Cancellation by You

5.1. All cancellations must be made in writing by either letter or email prior to the commencement date of the Course. Cancellation Fees for training courses or places cancelled are subject to the following charges:

If you would like to make a substitution please call us on 01689 884100.  Substitutions, with the exception of courses involving an examination, can be made at any time up to commencement of the course without penalty.

* A transfer fee will be charged if a delegate transfers to another JTL Course within the stated cancellation periods

6. Payment Terms

6.1. Bookings must be accompanied by full payment of the Fee, or your employer’s authorisation to be invoiced for the Fee. 

6.2. Where your employer has agreed to pay the Fee, full payment is required in advance of commencement of the Course, either by credit/debit card or immediately on receipt of invoice.

6.3. Accounts will be subject to a trading payment history and credit checks, and are at the sole discretion of JTL.

6.4. If we do not receive the Fee in accordance with these terms, we reserve the right to refuse you access to the Course.

7.       Intellectual Property Rights

7.1. All intellectual property rights in any and all content and Materials created and made available to you for the purposes of training are and shall remain the property of JTL.  You shall not do anything which adversely affects our rights and interests, including but not limited to:

7.1.1. Copying, reproducing, modifying, redistributing or in any way commercially exploiting the Courses, Materials, website or other content.

7.1.2. Falsifying the true ownership of the Courses, Materials, website and other content.

8. Liability

8.1. We will not be liable to you for any claims, liabilities, losses, damages, costs, expenses, fines and/or penalties unless they are caused directly by our negligence and/or breach of these Terms.

8.2. We shall not be liable to you for any (a) loss of profit, revenue, business, opportunity, goodwill, interest or savings, whether direct or indirect, howsoever arising, (b) for any consequential, economic, indirect or special loss howsoever arising.

8.3. Under no circumstances shall our liability to you (whether in contract, tort (including negligence), breach of statutory duty or otherwise) exceed the Fee.

9.       Data Protection

9.1. We will use any personal data (as defined by the Data Protection Act 1998) collected during the course of your dealings with us in accordance with UK data protection legislation.

10.    Attendance on the Course

10.1. JTL reserves the right to ask you to leave a training course if it is felt that you are unable to participate and contribute to the learning on the course.  This includes inappropriate behaviour and actions that are detrimental to the learning received by other participants on the course.

10.2. Equal Opportunities

Neither JTL or you as a delegate shall unlawfully discriminate within the meaning and scope of equal opportunities legislation including, but not restricted to discrimination on the basis of race, gender, religion or belief, age, sexual orientation or disability.

10.3. Health and Safety

10.3.1. Both you and JTL shall acknowledge responsibility under the Health & Safety at Work Act 1974 and any other acts, orders, regulations and codes of practice relating to health and safety in relation to this agreement and to comply with such legislation.

10.3.2. JTL reserves the right to exclude you from the training course, if in the opinion of JTL you pose a risk to yourself or to others for any reason including intoxication, inappropriate attire or disorderly behaviour.
